Welcome to PetAvatar. These Terms of Service ("Terms") govern your access to and use of our web-based AI Pet Avatar Generator (the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
PetAvatar lets you upload photos of your pets and, using our AI engine, transform them into high-resolution digital avatars in a variety of illustrative styles (cartoon, anime, fantasy, etc.). Features include:
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
To use the Service, you must register for an account and provide accurate, up-to-date information. You are solely responsible for safeguarding your password and all activities under your account.
We offer monthly and annual subscription plans, as well as one-time credit bundles. All fees are charged in USD and include applicable taxes.
Subscriptions renew automatically on the same day each billing period unless canceled at least 24 hours before renewal. You may cancel anytime via your account dashboard.
If payment fails, we may suspend your access until you update your billing information.
All purchases are final, except where required by law. In exceptional circumstances, PetAvatar may, at our sole discretion, grant refunds or credits. To request a refund, contact support@petavatar.com within 14 days of purchase, explaining your reason.
You retain ownership of photos you upload ("User Content"). By uploading, you grant PetAvatar a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your User Content solely to provide and improve the Service.
PetAvatar reserves all other intellectual property rights.
You agree not to:

THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. PETAVATAR DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETAVATAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, NOR FOR LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID IN THE PRIOR SIX MONTHS, OR USD 50, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless PetAvatar and its officers, directors, employees, and agents from any claim, demand, liability, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms or any applicable law.
We may suspend or terminate your access, without notice, for any violation of these Terms. Upon termination, all rights granted to you will immediately cease.
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Wilmington, Delaware.
Before filing a lawsuit, you agree to try to resolve disputes by emailing support@petavatar.com. If we cannot resolve your dispute within 30 days, you or we may pursue legal remedies.
Entire Agreement: These Terms constitute the entire agreement regarding the Service.
Severability: If any provision is unenforceable, the remainder will remain in full force.
Waiver: Any waiver must be in writing.
Notices: We may provide notice via email or by posting on our website.
